Section 101. Whoever wilfully, intentionally and without right, by the explosion of gunpowder or of any other explosive, unlawfully damages or destroys property or injures a person, shall be punished by imprisonment in the state prison for not more than twenty years or in jail for not more than two and one half years or by a fine of not more than one thousand dollars.
