In three cases the U.S. Dept of Justice requested records of patients who had late-term abortions. A federal judge in Chicago upheld a lower court decision that blocked the government from obtaining women's confidential medical records, while federal judges in New York and Michigan ordered hospitals in those states to turn over the records. The plaintiffs argued that the law must be struck down for failing to permit certain late-term abortions to protect women's health. The Justice Department said that it needs to review medical records to examine whether the abortions were ever medically needed.

In one chapter in this book the author discusses privacy rights and abortion. Roe vs. Wade was based on Griswold v. Conneticut, the case that declared it was illegal to get contraceptives. Griswold allowed getting contraceptives by saying that it violated the privacy of the marriage. In Roe, the court expanded the liberty protected in Griswold to include the new right to abortion. The author disagrees with this reasoning.
