Information Automatically Collected On The Site

This site automatically collects and stores some information during your visit. This site does not collect "cookies" but it does collect and store indefinitely your Internet Protocol ("IP") address, (which does not identify you as an individual), as well as information about the date and time of your visit, whether a file you have requested exists, and how many "bytes" of information were transmitted to you over the Web from this site. We use your IP address to assess the frequency of visits to this site and the popularity of its various pages and functions. We will not attempt to match any personally identifiable information that you provide to us with your IP address, unless there are reasonable grounds to believe that doing so would provide information that is relevant and material to a criminal investigation.

Information Voluntarily Provided By You

This site allows you to voluntarily provide some personally identifiable information to HWSCP. If you subscribe to a mailing list or send us an e-mail message, you will submit your e-mail address to HWSCP. If you fill out an online form to provide feedback, to register for an event, to make a file review request, or to submit public comment, you will be asked by HWSCP to provide some or all of the following personally identifiable information:

  • Affiliation/Company
  • City/Town
  • State/Province
  • Country
  • Telephone Number
  • Fax Number
  • E-mail address

As a general matter, the above referenced personally identifiable information is subject to disclosure, upon request, under the public records law. However, certain personal information provided to or held by HWSCP constitutes "personal data" that must be kept confidential by HWSCP in accordance with the Fair Information Practices Act (Massachusetts General Laws Chapter 66A), including:

  1. medical information;
  2. personnel information that is evaluative in nature;
  3. any data of a highly personal nature that would constitute an unwarranted invasion of personal privacy if disclosed (e.g., marital status, paternity, substance abuse, etc.); or
  4. enforcement-sensitive information on individuals (e.g., the identity of persons reporting violations).

The HWSCP site will not be used to collect the types of personal data identified in categories 1 - 3 above. However, you are allowed to submit enforcement sensitive information to HWSCP via its Web site, such as e-mailing HWSCP to report an environmental violation. If you chose to send an e-mail to HWSCP notifying us of an environmental violation, your e-mail address and any other personally identifiable information will be protected as confidential personal data and will not be disclosed under a public records request. If HWSCP is directed to release such personal data in response to a subpoena or other compulsory legal action, HWSCP will use its best efforts to provide advance notice to you of the release.

How We Use Your Personally Identifiable Information

HWSCP will use your e-mail address to include you on a mailing list you subscribed to or to respond to an e-mail message you sent. When you submit information via an online form, we will use that information for the purpose stated on the form that you submit. HWSCP will not sell any personally identifiable information collected through e-mail or online forms.

Security Of Your Personally Identifiable Information

You should be aware that this site does not encrypt communications through incoming e-mail or online forms. Therefore, you should not send information that you consider highly sensitive via e-mail or through a form on this Web site. We use standard security measures to ensure that your personally identifiable information is not lost, misused, altered, or unintentionally destroyed. We also use software programs to monitor network traffic, to identify unauthorized attempts to upload or change information, or to otherwise cause damage. Except for authorized law enforcement investigations, no attempts are made to identify individual users or their usage habits.

Dissemination Of Your Personally Identifiable Information

The information that you voluntarily submit will be disclosed to Commonwealth employees or officials with a "need to know" for purposes of fulfilling their job responsibilities. They will use this information to answer your questions, respond to any requests for assistance, and fulfill the Commonwealth's legal obligations. In order to answer your questions or fulfill your requests for assistance, we may provide the information submitted by you to a specific person or to the government agency responsible for the matters referred to in your communication.

You should be aware that anytime you submit personally identifiable information to us through an e-mail or a form, the dissemination of that information within or outside of HWSCP is ultimately governed by the Public Records Law, the Fair Information Practices Act (Massachusetts General Laws Chapter 66A), Executive Order 412, and other applicable laws and regulations. For example, as a general rule, personally identifiable information contained in a public record is subject to disclosure, upon request, under the public records law. For this reason, part or all of the information you send us may be provided to a member of the public in response to a public records request.

Your Access And Opportunity To Correct Personally Identifiable Information

You have the right to access and the opportunity to correct information that you submit to HWSCP. The Public Records Law and the Fair Information Practices Act outline your rights to get information about you that is in our records. Changes To This Policy

We will post any changes to this policy on this Web page at least 30 days before they take effect. Any information we collect under the current privacy policy will remain subject to the terms of this policy. Any new information we collect under a changed policy will be subject to that new policy.

Definition of Terms

Cookies are files that a Web site can place on your computer. A cookie file contains unique information that a Web site can use to track such things as your password, lists of Web pages you have visited, and the date when you last looked at a specific Web page, or to identify your session at a particular Web site. Executive Order 412 - In 1999, Acting Governor Swift issued Executive Order 412, which enhanced the privacy protection given to any information about you as a named individual held by the Executive Department of state government. Executive Order 412 limits the collection and dissemination of personally identifiable information within the Executive Department. This site complies with Executive Order 412, so all of the personally identifiable information that you submit to this site is given the privacy protections set forth in Executive Order 412. "Internet Protocol Address" or "IP Address" is a series of numbers that identifies each computer and machine connected to the Internet. An IP address enables a server on a computer network to send you the file that you have requested on the Internet. The IP address disclosed to us may identify the computer from which you are accessing the Internet, or a server owned by your Internet Service Provider. Because it is machine-specific, rather than person-specific, an IP address is not, in and of itself, personally identifiable information.

Personally Identifiable Information - We use the term "personally identifiable information" to mean any information that could reasonably be used to identify you, including your name, address, e-mail address, Social Security number, birth date, bank account information, credit card information, or any combination of information that could be used to identify you.

Personal Data - We use the term "personal data" to mean any information that can be readily associated with a person because of name, identifying number, mark or description, and that is NOT contained in a public record. As a general rule the following types of personal information are "personal data" and exempt from public disclosure:

  1. medical information;
  2. personnel information that is evaluative in nature;
  3. any data of a highly personal nature that would constitute an unwarranted invasion of personal privacy if disclosed (e.g., marital status, paternity, substance abuse, etc.); or
