The parties agree on a date that employees must be on the payroll of the employer if they are to be entitled to vote. Usually, this date will be the last day of the payroll period immediately preceding the execution of the consent agreement, or the issuance of the direction of election. If the parties agree other dates may be selected, but the Division will not approve a cut-off date that operates to disenfranchise substantial numbers of voters.
