Town of Arlington and Arlington Police Patrolman’s Association MUP-14-3750 CERB Decision (September 30, 2015). The Hearing Officer concluded that the Town of Arlington had violated Section 10(a)(5) and, derivatively, Section 10(a)(1) of M.G.L. c. 150E (the Law) when it refused to bargain with the Arlington Police Patrolmen’s Association (APPA or Union) over its proposed use of an assessment center as a criteria for promotion from the bargaining unit position of patrol officer to the non-bargaining unit position of sergeant. The Town filed a timely appeal from the decision and the Union filed a response. Upon consideration of the Hearing Officer’s decision and the parties’ supplementary statements, the CERB affirmed the Hearing Officer’s decision in its entirety.
