Only complaints that demonstrate violation of a provision(s) of the Employment Agency Statute will be investigated by the Employment Agency Program. Complainants will be notified about the status of their complaint. Licensees/agency owners about which a complaint has been filed will be contacted by the Employment Agency Program, and an inspection of agency records will occur. When a hearing is required, the licensee (agency owner) is required to attend and will be provided ample time to respond to the complaint; complainants are also required to attend the hearing to present his/her case and evidence to support the claim(s). Hearings are not open to the public.
Please note: DLS does not regulate quality of care provided by caregiver services. The Employment Agency Program regulates the employment and service agency industry in Massachusetts for the purpose of worker protection.

Information obtained by the Department of Labor Standards (DLS) in investigating claims shall be confidential and for the exclusive use and information of DOS in the discharge of duties under the Employment Agency Statute, M.G.L. c. 140, §§ 46A-46R .
