Re: Job Classification Request

I am writing in response to your request for this Office's written opinion regarding the applicability of the Massachusetts Prevailing Wage Law, G.L. c. 149, §§26-27. Specifically, you have asked for a determination of the appropriate job classification for two tasks performed on a public works project.

As I understand it, your company is performing natural gas main installation works for the municipalities of XXXX, YYYY, and ZZZZ. The tasks in question are the operation of a walk-behind pneumatic or gasoline-powered saw to cut bituminous or concrete pavements. The appropriate job classification for the former task is Pneumatic Drill/Tool Operator (Heavy & Highway), and the classification for the latter is Jackhammer/Paving Breaker Operator.
