The Massachusetts Unemployment Insurance Law grants employers the right to appeal some determinations made by DUA. In order to be submitted timely, an appeal must be postmarked within ten days from the date the disputed determination is mailed to the Employer. A hearing will be scheduled before an impartial hearing officer assigned by the DUA Hearings Department. Relevant testimony and evidence can be presented at the hearing and a written decision will then be rendered by the hearing officer to all interested parties.
Filing an Application for Review with the Board of Review
Unless otherwise provided by law, parties aggrieved by a decision of the DUA Hearings Department will have the right to appeal to the Board of Review. To initiate that appeal, a party must file an application with the Board of Review within 30 days of the date of the DUA Hearings decision. Form 1801 should be completed and sent to the Board of Review in accordance with the provisions of the law and the regulations specified below.
