RE: Change to Fee Schedule for Impartial Medical Examiners

On July 1, 2011, the Department of Industrial Accidents will institute in a new contract with its Impartial Medical Examiners pursuant to M.G.L. c. 152, §11A. Within that new contract the fees for conducting the deposition of an Impartial Examiner will be increased for the first time since 1986. This fee increase will result in a more equitable compensation schedule for the Impartial Examiner and will more fairly compensate them for their time and efforts when they must testify on medical issues at depositions. The fees set out below are to be paid by the deposing party to the deponent medical examiner. These fees are not payable to the Department. The exam fee remains at $450.
The new fee structure is as follows:
First two hours - $700
Each additional hour (up to two hours) - $150
Note: Additional hours beyond this must be approved by the Administrative Judge.
The above fee schedule shall take effect July 1, 2011.
