Form 46A "Request For Conference In Conjunction With Lump Sum Under § 48 and accompanying guidelines are available from the Department at the front desk and online.
The following instructions apply to the use of Form 46A:
- Requests for M.G.L. ch. 152, § 46A conferences must be made by filing a Departmental Form 46A with the Central Scheduling Unit. A notice giving the name of the assigned judge, the time and place will be sent to all parties.
- Failure to fully complete the 46A Form will result in the rejection of the form, which may delay the scheduling of a § 46A conference.
- At least ten (10) days prior to the proceeding, the moving party must submit a memorandum to the administrative law judge, with copies to all parties, including the lienholder, stating the reasons why, and for what amount, the lien should be discharged. (PLEASE NOTE THAT THIS HAS BEEN DONE).
- At least five (5) days prior to the proceeding, the lienholder must submit a response memorandum to the administrative law judge, with copies to all parties.
