To the selectmen of the following municipalities: Duxbury, Plymouth, Bourne and Sandwich
Ladies & Gentlemen:
The Division of Marine Fisheries has determined that shellfish, except for carnivorous snails, channeled and knobbed whelks, and moon snails (Lunatia heros) and (Polinices duplicatus), from the below-defined area no longer contains biotoxins (PSP) from the phytoplankton Alexandrium (spp) in excess of established standards.
Therefore, under authority of Massachusetts General Laws, Chapter 130, Section 74A, 75 and 322 CMR 7.01 (7) at sunrise on October 4, 2008, the PSP closure of June 12, 2008 will be amended as follows in the below-defined area. Those areas classified as APPROVED and in the “open “ status to shellfish harvesting prior to the PSP closure are now open to the harvest of shellfish, except carnivorous snails, channeled and knobbed whelks, and moon snails (Lunatia heros) and (Polinices duplicatus) for direct human consumption subject to local rules and regulations under authority of Massachusetts General Laws Chapter 130, section 52. Similarly, those areas classified as CONDITIONALLY APPROVED are open subject to the classification conditions.
STATUS: OPEN TO SHELLFISHING
“The waters, flats and all tributaries of those shellfish growing areas in that portion of CCB:35 north of the Bourne/Sandwich town line, CCB:39, CCB:41 and MB:1 in the Towns of Sandwich, Bourne, Plymouth and Duxbury and CCB:48 and CCB:51 in Cape Cod Bay.”
