Once a Complaint has been filed at the MCAD, the Investigator mails the Complaint to the Respondent(s) in order to obtain a "Position Statement" from the Respondent which outlines the respondent's position regarding the allegations in the complaint.
Next, a meeting with the Complainant and the Respondent(s) is sometimes held to gather information surrounding the complaint and to discuss the possibility of a voluntary resolution of the complaint. This is called the Investigative Conference. (Download the Investigative Conference Fact Sheet ). After the investigative Conference, the Investigator will continue to gather information by interviewing witnesses, obtaining relevant documents, making visits to the place of employment or apartment, or other appropriate on-site visits.
The investigation culminates with an issuance of a Determination.
