In light of today’s Supreme Judicial Court’s decision in Commonwealth v. Cole, the petitioner, Gangi, was not a "prisoner" for purposes of G. L. c. 123A, § 12 (b) at the time the Commonwealth filed its Sexually Dangerous Person petition, because his sentence and incarceration under the Community Parole Supervision for Life statute, G. L. c. 127, § 133D (c), were unlawful.
