S.J.C. Order (Resignation) entered by Justice Cowin on December 26, 2000, with an effective date of January 26, 2001. 1


On October 4, 2000, the respondent submitted an affidavit of resignation to the Board of Bar Overseers. The respondent acknowledged that he was the subject of McKnight v. State Bar of California, 53 Cal. 3d 1025 (Cal. 1991), bar discipline proceedings in California that had resulted in his suspension from the practice of law in California on June 6, 1991. The respondent did not notify Massachusetts bar counsel of his suspension in California, and bar counsel did not discover that the respondent had been suspended there until May 2000.

On December 7, 2000, the Board of Bar Overseers voted to recommend to the court that the affidavit of resignation be accepted. On December 26, 2000, the Supreme Judicial Court for Suffolk County entered an order accepting the respondent's resignation as a disciplinary sanction, effective January 25, 2001.
