S.J.C. Order of Disbarment entered by Justice Spina on January 30, 2001. 1


On July 31, 2000, the respondent was convicted in the Hampshire Superior Court of five counts of rape and abuse of a child under sixteen, in violation of G. L. c. 265, § 23. The respondent was sentenced to state prison for a term of not less than three years nor more than four years on four counts and to probation for life on one count. These convictions were for serious crimes as defined by S. J. C. Rule 4:01, § 12, and the respondent's conduct violated Mass. R. Prof. C. 8.4(b) and (h).

Bar counsel filed a petition for discipline on September 26, 2000. The respondent did not file an answer. Bar counsel requested that the allegations of the petition for discipline be deemed admitted and that the Board of Bar Overseers recommend to the court that the respondent be disbarred, with the effective date retroactive to September 20, 2000, the date of the respondent's temporary suspension. On November 13, 2000, the board voted to recommend to the court that the respondent be disbarred effective September 20, 2000.

An information was filed with the Supreme Judicial Court for Suffolk County on December 5, 2000. On January 30, 2001, the court entered a judgment of disbarment, effective September 20, 2000.
