S.J.C. Judgment of Resignation in Lieu of Suspension entered by Justice Cowin on August 5, 2003, with an effective date of September 4, 2003.1


On January 7, 2003, the respondent was convicted in the Plymouth District Court of Grafton County, New Hampshire, of simple assault in violation of RSA 631:2a. He was fined $1,000 and sentenced to twelve months in the house of correction, suspended for a period of two years.

The bar counsel filed a petition for discipline on April 16, 2003. On June 18, 2003, the respondent submitted an affidavit of resignation pursuant to S. J. C. Rule 4:01, § 15. The respondent acknowledged that he had been convicted of simple assault and that his conduct had violated Mass. R. Prof. C. 8.4(b) and (h). The respondent averred that he was no longer practicing law, that he did not reside in the United States, and that he desired to resign from the practice of law.

On July 14, 2003, the Board of Bar Overseers voted to recommend to the court that the respondent’s affidavit of resignation in lieu of suspension be accepted. On August 5, 2003, the Supreme Judicial Court for Suffolk County (Cowin, J.) accepted the affidavit of resignation effective thirty days from the entry of the order.
