S.J.C. Judgment of Disbarment entered by Justice Gants on September 22, 2009.1


On March 14, 2006, the respondent was convicted of conspiracy to commit automotive insurance fraud in violation of G. L. c. 274, § 7. The underlying facts are recited in Commonwealth v. Elias, an unpublished memorandum and order issued by the Appeals Court on February 5, 2009, reported at 2009 WL 259097. The crime was treated as a misdemeanor by the trial court.

The respondent was temporarily suspended from the practice of law on May 2, 2006. Bar counsel filed a petition for discipline against the respondent on September 19, 2006. Disciplinary proceedings were stayed at the respondent’s request until his appeal from his conviction was decided.

After his conviction was affirmed, the respondent did not participate in further bar discipline proceedings. Bar counsel provided to the Board of Bar Overseers as a matter in aggravation an admonition of the respondent reported as Admonition No. 01-29, 17 Mass. Att’y Disc. R. 710 (2001), and filed a disposition memorandum requesting disbarment retroactive to the effective date of the temporary suspension.

On July 13, 2009, the Board of Bar Overseers voted to recommend that the respondent be disbarred retroactive to May 2, 2006. On September 11, 2009, a hearing was held in the Supreme Judicial Court for Suffolk County on the information and record of proceedings filed by the board. The respondent did not appear at this hearing. On September 15, 2009, the county court (Gants, J.) entered a judgment of disbarment effective retroactive to May 2, 2006.
