S.J.C. Order of Indefinite Suspension entered by Justice Greaney on September 26, 2006, with an effective date of October 26, 2006.1


I have reviewed the record in this case and heard and considered the arguments of bar counsel and Mr. Patrican. The practice of the Board of Bar Overseers (board) in this type of case, where timely full restitution has been made by the offending lawyer, is to request a judgment of indefinite suspension instead of a judgment of disbarment. I conclude that the violations alleged have been proved. Based on the board's practice, referred to above, and appropriate precedent, see Matter of Schoepfer. 426 Mass. 183, 188 (1997); Matter of Brvan. 411 Mass. 288, 292 (1991); Matter of Guidry. 15 Mass. Att'y Discipline Rep. 255, 256-257 (1999), I further conclude that Mr. Patrican should be indefinitely suspended.

Accordingly, it is ORDERED that a judgment of indefinite suspension be entered in this case together with an order that Mr. Patrican pay to the board the costs of the proceedings in the amount of $3,339.93.
