MEMORANDUM OF DECISION

This matter came before me on an information and record of proceedings and a vote and recommendation of the Board of Bar Overseers filed by the Board on June 23, 2006. After a review of the papers, I held a telephone hearing with the parties on August 30, 2006. The only matters in dispute were the appropriate length of an order suspending the respondent and the requirements to be imposed on the respondent as a condition of reinstatement.

At the hearing, the parties agreed to compromise their positions and I conclude that the result of their compromise is a reasonable one. That compromise includes a statement that the respondent agrees that his belief that the complaints against him were meritless was not a proper factor in mitigation. The order of suspension imposed by me today sets forth the compromise between the parties.
