S.J.C. Order of Term Suspension entered by Justice Cowin on November 5, 2007.1


On June 1, 2007, the Hingham District Court found sufficient facts after a bench trial that the respondent was in possession of a Class D drug in violation of G. L. c. 94C, § 34. The case was continued without a finding until May 30, 2008, with the condition that the respondent stay free of drugs.

On July 24, 2007, bar counsel filed a petition for discipline alleging that the respondent had violated Mass. R. Prof. C. 8.4(b) and (h). The respondent filed an answer.

On September 24, 2007, the parties filed a stipulation that included an amended answer and an agreement that the respondent should be suspended from the practice of law for two months. The parties agreed that the respondent had been convicted of misdemeanor possession of marijuana and that bar counsel could prove that the circumstances of the crime suggested the potential for sale of marijuana, a matter in aggravation.

On October 15, 2007, the Board of Bar Overseers voted to accept the stipulation of the parties and their recommendation for a two-month suspension. On November 5, 2007, the Supreme Judicial Court for Suffolk County entered an order suspending the respondent for two months, effective immediately.
