S.J.C. Judgment of Disbarment entered by Justice Greaney on October 28, 2008.1

SUMMARY2

The Court accepted the respondentís affidavit of resignation and entered an order of disbarment retroactive to the respondentís temporary suspension on December 24, 2007.

The respondentís affidavit of resignation acknowledged that the charges recited in the first count of a seven-count statement of charges against him had been found to be true after hearing by the Board of Bar Overseers and that the charges in the remaining counts could be established by a preponderance of the evidence. The statement of charges recited two instances in which the respondent had collected settlement checks on behalf of clients and converted the proceeds to his own use and two instances in which the respondent had conducted closings on real estate and converted the funds to his own use by failing to pay off the sellerís mortgage.

The statement of charges also recited that indictments were pending in the Suffolk Superior Court charging the respondent with more than 135 felony counts, including motor vehicle insurance fraud, conspiracy, forgery, and larceny over $250. On September 25, 2008, after the affidavit of resignation had been submitted, the respondent pleaded guilty to all counts contained in the Suffolk County indictments and was sentenced to a term of imprisonment.

The respondentís conduct constituted conversion, misappropriation of trust property, dishonesty, fraud, and deceit in violation Mass. R. Prof. C. 8.4(c); failure to segregate and safeguard client property in violation of Mass. R. Prof. C. 1.15(b) and (c); and commission of a criminal act that reflects adversely on the lawyer's honesty, trustworthiness, or fitness as a lawyer in violation of Mass. R. Prof. C. 8.4(b).
