SUMMARY2

On May 23, 2008, the respondent was convicted in the Newbury District Court of operating under the influence, 3rd offense, and leaving the scene of an accident causing property damage. For the crime of operating under the influence, the respondent was sentenced to two years in the house of correction with 150 days to serve and the balance suspended for three years, and, for leaving the scene of an accident, the respondent was sentenced to a concurrent term of 90 days in the house of correction.

The offenses occurred on March 28, 2007. The respondent transferred to inactive status on April 22, 2008. He was temporarily suspended on June 12, 2008.

On July 28, 2008, bar counsel filed a petition for discipline. The respondent filed an answer on August 14, 2008. On October 22, 2008, the respondent filed an amended answer admitting to violations of Mass. R. Prof. C. 8.4(b) and (h) and stipulating to a six-month suspension retroactive to June 12, 2008, the effective date of the temporary suspension.

On November 10, 2008, the Board of Bar Overseers voted to accept the stipulation and recommend to the court that the respondent be suspended for six months retroactive to June 12, 2008. On November 25, 2008, the Supreme Judicial Court for Suffolk County (Ireland, J.) entered an order suspending the respondent for six months retroactive to June 12, 2008.
