S.J.C. Judgment of Resignation entered by Justice Cowin on September 4, 2008, with an effective date October 6, 2008.1


On October 5, 2005, the respondent was convicted of misdemeanor domestic battery in violation of §§ 242-243(e) of the California Penal Code in Superior Court, Santa Clara County, California. The respondent reported the conviction to bar counsel on June 2, 2008, and a notice of the conviction was filed in the Supreme Judicial Court for Suffolk County.

On July 21, the respondent submitted to the Board of Bar Overseers an affidavit of resignation pursuant to S. J. C. Rule 4:01, § 15. On August 15, 2008, the Board of Bar Overseers voted to recommend to the Supreme Judicial Court that the respondent’s affidavit of resignation be accepted in lieu of suspension. On September 4, 2008, the Supreme Judicial Court for Suffolk County (Cowin, J.) entered judgment accepting the affidavit of resignation in lieu of suspension.
