On June 17, 2008, the respondent Stephen P. Harte was convicted in Franklin Superior Court of misdemeanor motor vehicle homicide while operating under the influence of intoxicating liquor in violation of G. L. c. 90, § 24G(b). He was sentenced to two years in the house of correction, with thirty days to serve and the balance suspended, and placed on probation for three years with conditions that he perform sixty hours of community service, consume no drugs or alcohol, and submit to random screens.

The respondent was temporarily suspended from the practice of law on August 15, 2008. On October 20, 2008, bar counsel filed a petition for discipline alleging that the respondent’s criminal conduct violated Mass. R. Prof. C. 8.4(b) and (h). On January 6, 2009, the respondent and bar counsel filed a stipulation in which the respondent admitted to the allegations of the petition for discipline and the parties recommended that the petitioner be suspended from the practice of law for twelve months retroactive to the effective date of his temporary suspension.

On January 20, 2009, the Board of Bar Overseers voted unanimously to accept the parties’ stipulation and to file an Information with the Supreme Judicial Court for Suffolk County recommending a one-year suspension effective August 15, 2008. On February 6, 2009, the county court entered an order suspending the respondent for one year effective August 15, 2008.
