S.J.C. Judgment of Disbarment entered by Justice Ireland on March 23, 2009.1

SUMMARY2

On November 26, 2008, the respondent was convicted Boston Municipal Court of open and gross lewdness in violation of G. L. c. 272, § 16; assault and battery in violation of G. L. c. 265, § 13A; and two counts of indecent exposure in violation of G. L. c. 272, § 53. Open and gross lewdness is a felony. In each case, the victim was a high school student. The respondent was sentenced to concurrent terms of two years in the house of correction on the first two counts and six months on the charges of indecent exposure, all suspended for three years subject to conditions including continued sex offender treatment; staying away from all MBTA stations and modes of transportation, Boston Latin School, and all other Boston public schools; no contact with the victims; and twenty-five hours of community service.

The respondent was temporarily suspended from the practice of law on January 9, 2009. On March 4, 2009, the respondent submitted an affidavit of resignation pursuant to S. J. C. Rule 4:01, § 15, in which he admitted to the convictions and that his conduct had violated Mass. R. Prof. C. 8.4(b) and (h). Bar counsel recommended that the affidavit of resignation be accepted and that a judgment of disbarment enter.

On March 9, 2009, the Board of Bar Overseers voted to recommend to the court that the affidavit of resignation be accepted and a judgment of disbarment enter. On March 23, 2009, the Supreme Judicial Court for Suffolk County (Ireland, J.) ordered that the affidavit of resignation be accepted and a judgment of disbarment enter.
