S.J.C. Order of Indefinite Suspension entered by Justice Spina on November 22, 2010.1

SUMMARY2

On June 24, 2010, the respondent, Paula L. Philbrook, was disbarred by the New Hampshire Supreme Court. The disbarment was based upon the respondent’s felony conviction for wire fraud (18 U.S.C. § 1343) in the United States District Court for the District of New Hampshire. The conviction resulted from two mortgage loan transactions in which the respondent engaged as borrower to finance construction of homes. In both mortgage appplications, the respondent substantially overstated her income and understated her debts. In one of the transactions, the respondent also misrepresented in an affidavit that she occupied the house, whereas at the time of the affidavit the house was rented to a third party and listed for sale.

On October 9, 2009, the respondent was immediately suspended by the New Hampshire Supreme Court as a result of her agreement on September 29, 2009, to plead guilty to the criminal charge. On October 21, 2009, bar counsel filed a petition with the Supreme Judicial Court for Suffolk County seeking a temporary suspension as reciprocal discipline. After the parties waived hearing and assented to such an order, the Court entered an order of immediate temporary suspension on December 22, 2009.

On July 14, 2010, bar counsel filed a petition for reciprocal discipline with the Supreme Judicial Court for Suffolk County based upon the New Hampshire disbarment. The respondent filed a response on August 13, 2010, and bar counsel filed a memorandum on disposition on October 8, 2010. On November 22, 2010, the Court (Spina, J.) entered an order of indefinite suspension, retroactive to December 22, 2009.
