S.J.C. Order of Term Suspension entered by Justice Ireland on September 21, 2009.1

SUMMARY2

The respondent is an attorney duly admitted to the Bar of the Commonwealth on February 22, 1978. On November 1, 1993, the respondent was placed on disability inactive status pursuant to S.J.C. Rule 4:01, section 13(5), effective immediately. On and after November 1, 1993, the respondent was prohibited from engaging in the practice of law and on and after July 1, 1997, was additionally prohibited from engaging in paralegal work as provided in S.J.C. Rule 4:01, sections 17(3) and (7) (as amended effective July 1, 1997).

On or before 2001 and continuing to November 2008, the respondent worked for another attorney as a paralegal performing the usual paralegal functions. The respondent was unaware of the prohibition on him being employed as a paralegal after July 1, 1997.

The respondentís conduct of engaging in paralegal work while on disability inactive status violated S.J.C. Rule 4:01, section 17(7). On June 19, 2009, the respondent was removed from disability inactive status and temporarily suspended from the practice of law.

This matter came before the Board on a stipulation of facts and disciplinary violations and a joint recommendation for discipline by a suspension of six months and one day, retroactive to the date of the respondentís temporary suspension. In addition, it was agreed that reinstatement would be subject to a formal proceeding under S.J.C. Rule 4:01, section 18. On September 14, 2009, the Board accepted the partiesí recommendation and filed an Information with the Supreme Judicial Court. On September 21, 2009, the Court accepted the Boardís recommendation and so ordered.
