IN RE: SUSAN P. OTIS

S.J.C. Judgment of Disbarment entered by Justice Cordy on March 27, 2002.1

SUMMARY2

After a jury trial, the respondent was found guilty on April 12, 1999, in the United States District Court for the District of Massachusetts of one count of conspiracy to commit bankruptcy fraud in violation of 18 U.S.C. ß 371. On August 4, 1999, the respondent was sentenced to five months' incarceration, 2 years of probation to take effect upon her release, and 150 hours of community service. On November 28, 2000, the United States Court of Appeals for the First Circuit affirmed the conviction, United States v. Stein, 233 F. 3d 6 (1st Cir. 2000).

Bar Counsel commenced disciplinary proceedings on September 22, 1999. The proceedings were deferred pending the outcome of the respondentís appeal.

On June 8, 2001, a hearing committee of the Board of Bar Overseers held a hearing on the petition for discipline. On August 23, 2001, the hearing committee filed its Report in which it recommended that the respondent be disbarred from the practice of law and that the order of disbarment be retroactive to the date of the respondentís temporary suspension on May 24, 1999.

On October 15, 2001, the Board of Bar Overseers voted to adopt the report of the hearing committee and its recommendation that the respondent be disbarred from the practice of law, retroactive to the date of the respondentís temporary suspension from the practice of law.

On March 27, 2002, the Supreme Judicial Court for Suffolk County ordered that the respondent be disbarred retroactive to May 24, 1999.
