Public Reprimand No. 2008-26


Order (public reprimand) entered by the Board November 21, 2008.


On May 15, 2008, the respondent admitted to sufficient facts in the Boston Municipal Court to two counts of assault and battery in violation of G.L. c. 265, ß 13A. The respondentís criminal conduct involved two instances of unwanted contact with another passenger on a commuter train. The case was continued without a finding until May 13, 2009, with conditions that the respondent stay away from the victim. The respondentís conduct violated Mass. R. Prof. C. 8.4(b) and (h).

On July 25, 2008, bar counsel filed a petition for discipline. On October 20, 2008, the respondent filed an answer admitting to the allegation of the petition and to the rule violations. The parties also stipulated to a public reprimand as appropriate discipline.

On November 10, 2008, the Board of Bar Overseers voted to sanction the respondent by a public reprimand.
