Public Reprimand No. 2010-13

On March 14, 2008, the respondent was convicted in the Lawrence District Court of assault and battery in violation of G. L. c. 265, § 13A(a). The respondent received a suspended sentence of sixty days with conditions that he attend a program on anger management and refrain from teaching in elementary schools in the Commonwealth. His conviction was upheld in an unpublished decision issued by the Appeal Court on February 10, 2010, and reported at 2010 WL 444728. Further appellate review was denied on March 31, 2010.

On March 31, 2008, bar counsel filed a petition for discipline charging the respondent with the conviction and violation of Mass. R. Prof. C. 8.4(b) and (h). On May 10, 2010, the respondent filed an answer admitting to the facts and rule violations, and the parties stipulated to a public reprimand. The parties agreed that, in mitigation, the conduct was not related to the respondent’s representation of a client and the victim of the assault suffered minor superficial abrasions.

On June 14, 2010, the Board of Bar Overseers voted to sanction the respondent by a public reprimand.
