Hearing Scheduled for January 23, 2006
On September 30, 2005, the Commissioner of Insurance approved changes to Rule 13 of the Rules of Operation of the Commonwealth Automobile Reinsurers ("CAR"). As part of her decision, she ordered CAR to physically redistribute Exclusive Representative Producers ("ERPs") so as to establish for all servicing carriers overall parity in the quantity and quality of their ERP exposures.
Pursuant to the Commissioner's direction, CAR has submitted a plan for physical redistribution of ERPs to the Commissioner.
Since then, a number of CAR member companies have contacted the Commissioner to express their concerns about the redistribution procedure proposed by CAR and to request that the Commissioner order CAR to adopt, reconsider or implement a different methodology to achieve the redistribution of ERPs.
In light of the level of interest that has been expressed about CAR's proposal for the physical redistribution of ERPs, including Plymouth Rock Assurance Company's specific request for a public hearing, the Commissioner has decided to conduct a discretionary public hearing, to be held at the Division of Insurance at 10:00 a.m. on Monday, January 23, 2006. The purpose of the hearing is to allow all interested parties to be heard concerning the redistribution plan submitted by CAR, and the data that CAR has submitted to the Commissioner in support of its proposal.
Any person who wishes to present an oral statement at the public hearing is asked to submit a written notice of intent with the Division of Insurance on or before January 20, 2006. All others who wish to make an oral statement will be heard after those who submit such notice. Written statements may be submitted at any time prior to the conclusion of the hearing. All submissions relating to the hearing shall refer to Docket No. C2006-01 and be addressed to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts 02110-2208.
