Hearing Scheduled for September 20, 2006

Pursuant to the provisions of Chapter 30A and the authority granted the Commissioner under Chapter 1760, § 17 of the Massachusetts General Laws, a hearing will be held on Wednesday, September 20, 2006 at 10:00 a.m. at the Division of Insurance ("Division"), One South Station, Boston Massachusetts 02110-2208. The purpose of the hearing is to afford all interested parties an opportunity to provide oral and written testimony regarding proposed changes to 211 CMR 52.00 pdf format of 211_52_Proposed.PDF , Managed Care Consumer Protections and Accreditation of Carriers. The Division previously held a public hearing on certain proposed amendments to this regulation on May 26, 2006. At this time, the Division proposes additional amendments to 211 CMR 52.00, particularly, to 211 CMR 52.13(7) (previously designated as 211 CMR 52.14(7)). The Division proposes deleting 211 CMR 52.13(7)(c) as previously proposed at the May 26, 2006 hearing, which permitted carriers to exclusively refer insureds to the carrier's internet website for notices as to material modifications. The previously scheduled September 5, 2006 hearing has been cancelled.

Any person who wishes to testify concerning the proposed changes to this regulation must submit a Notice of Intent to Testify to the Docket Clerk at the Division on or before 12:00 p.m. Tuesday September 19, 2006. All other parties who wish to testify will be heard subsequent to those who notify the Division in advance. Written comments also will be accepted. Persons wishing to submit written comments may do so until the record of the hearing is closed. All notices and submissions should refer to Docket No. G2006-03, and must be sent to the Docket Clerk, Division of Insurance, One South Station, Boston, MA 02110-2208.
