TO THE CHIEF EXECUTIVE OFFICER ADDRESSED:

Under the provisions of SECTION 2 of Chapter 182 of the Acts of 2008 (the FY2009 Budget Appropriation Act), I am calling for the Consolidated Total Assets figure of your institution as of the close of business on September 30, 2008 in order to determine the assessment required under that provision. This assessment will be determined by utilizing the risk-based fee matrix which appears below.

On December 31, 2008, the Division will assign all state-chartered banks and credit unions to one of the three asset assessment categories below based upon the financial institution's supervisory rating assigned by its most recent report of examination conducted by either the Division or the appropriate federal regulator. Trust assets will be assessed at the rate of .0075 per $1,000. This assessment for calendar year 2008 replaces the assessment to be made under G.L. c.167, §2.
