|Hearing Scheduled for September 19, 2008|
Pursuant to Chapter 30A and the authority granted to the Commissioner of Insurance ("Commissioner") under Chapter 175E, § 10 of the Massachusetts General Laws, a hearing will be held at the Division of Insurance, One South Station, Boston, MA 02110-2208 on September 19, 2008 at 10:00 a.m.
The purpose of this hearing is to afford all interested persons an opportunity to provide oral and written comments on the proposed repeal of regulation 211 CMR 86.00, Reductions in Premium Charges for Private Passenger Motor Vehicles and Certain Commercial Motor Vehicles Equipped With An Anti-Theft Mechanism. The Division of Insurance ("Division") proposes to repeal 211 CMR 86.00 because it is outdated. Moreover, as the Commissioner has the authority to designate certain motor vehicles as "high-theft vehicles" in accordance with M.G.L. c. 175, § 113H, it is not necessary for the Commissioner to designate such vehicles by regulation
The proceedings concerning the proposed repeal of 211 CMR 86.00 shall be designated as Docket No. G2008-05. Any person who wishes to comment in person concerning the proposed repeal of this regulation must file a Notice of Intent to Comment with the Docket Clerk no later than September 18, 2008. Persons wishing to submit written comments may do so until the record of the hearing is closed. All submissions must be sent to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, MA 02110-2208 and must refer to Docket No. G2008-05. Persons who do not file such a Notice will be heard after those who do notify the Division in advance of the hearing. Copies of the regulation to be repealed are available from the Division, and also may be accessed on the Division's website at www.mass.gov/doi.
