Pursuant to Chapter 30A and the authority granted to the Commissioner of Insurance under Chapter M.G.L. c. 175, § 9 of the Massachusetts General Laws, a hearing will be held at the Division of Insurance, One South Station, Boston, MA 02110-2208 on June 8, 2009 at 10:00 a.m.
The purpose of this hearing is to afford all interested persons an opportunity to provide oral and/or written comments regarding proposed amendments to Regulation 211 CMR 71.00 , Medicare Supplement Insurance and Evidences of Coverage Issued Pursuant to a Risk or Cost Contract - To Facilitate the Implementation of M. G. L. c. 176K and Section 1882 of the Federal Social Security Act. The Division of Insurance proposes to amend 211 CMR 71.00 to comply with the federal Genetic Information Nondiscrimination Act (Public Law 110-233) which prohibits the use of genetic information or genetic testing in the issuance of Medicare Supplement policies. This federal law is effective July 1, 2009 and each state is required to implement the corresponding change by that date. The regulatory proceeding concerning the proposed amendments to 211 CMR 71.00 is designated as Docket No. G2009-03.
Any person who wishes to provide oral comment about the proposed amendments to 211 CMR 71.00 is requested to file a Notice of Intent to Comment with the Division on or before June 4, 2009. All other persons who wish to provide oral comment will be heard after those who notify the Division in advance. Written comments may be submitted until the record of the hearing is closed. All submissions must be sent to: Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts 02110-2208, and must refer to Docket No. G2009-03. Copies of the proposed regulation are available from the Docket Clerk or from the Division's website at www.mass.gov/doi.
