Pursuant to Chapter 30A and the authority granted to the Commissioner of Insurance ("Commissioner") under Chapter 175, § 113A and Chapter 175E, § 10 of the Massachusetts General Laws, a hearing will be held at the Division of Insurance, Fifth Floor, One South Station, Boston, MA 02110-2208 on January 20, 2009 at 10:00 a.m.
The purpose of this hearing is to afford all interested persons an opportunity to provide oral and written comments regarding the proposed repeal of 211 CMR 85.00, Massachusetts Motor Vehicle Insurance: Table of Short Rate Values . The Division of Insurance ("Division") proposes to repeal 211 CMR 85.00 because some of its provisions are outdated. The parts of the regulation that remain valid under the law are intended to be incorporated into a new regulation, 211 CMR 97.00.
The proceeding concerning the proposed repeal of 211 CMR 85.00 shall be designated as Docket No. G2008-12. Any person who wishes to comment in person concerning the proposed repeal of this regulation must file a Notice of Intent to Comment with the Docket Clerk no later than January 16, 2009. Persons wishing to submit written comments may do so until the record of the hearing is closed. All submissions must be sent to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, MA 02110-2208 and must refer to Docket No. G2008-12. Persons who do not file such a Notice will be heard after those who do notify the Division in advance of the hearing. Copies of the regulation to be repealed are available from the Division, and also may be accessed on the Division's website at www.mass.gov/doi.
