Hearing Scheduled for November 30, 2004

Pursuant to the provisions of chapter 30A, and in accordance with the authority granted to the Commissioner under chapter 175, §113B of the Massachusetts General Laws, the Division of Insurance will hold a hearing at 10:00 AM on Tuesday, November 30, 2004 at the offices of the Division of Insurance, Fifth Floor, One South Station, Boston, Massachusetts, 02110.

The purpose of the hearing is to afford all interested parties an opportunity to provide oral and written testimony regarding proposed amendments to 211 CMR 134.00, Safe Driver Insurance Plan. The Division of Insurance proposes to amend this regulation to implement the decision signed by Commissioner Bowler to update the Safe Driver Insurance Plan ("SDIP") for January 1, 2005 following an agreement among all involved parties that was reached in an adjudicatory hearing. The regulation is being modified to (1) adjust rate surcharges for experienced drivers with exactly one accident or violation in the past six years that is more than three years old, (2) increase surcharges for experienced drivers with SDIP step levels greater than 19 and (3) eliminate the manual rule known as the Clean Slate Rule.

Any person who wishes to testify concerning this regulation must file a Notice of Intent to Testify to the Division of Insurance on or before November 28, 2004. All other parties who wish to testify will be heard subsequent to those who notify the Division in advance. Persons wishing to submit written comments may do so until the record of the hearing is closed. All submissions must be sent to: Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts, 02110, and must refer to Docket # G2004-03.
