Hearing Scheduled for May 31, 2005

Pursuant to the provisions of the Plan of Operation of the Commonwealth Automobile Reinsurers ("CAR"), adopted in accordance with Massachusetts General Laws Chapter 175, section 113H, a hearing will be held on May 31, 2005, at 10:00 a.m. at the Division of Insurance, One South Station, Boston. The purpose of this hearing is to afford all interested parties an opportunity to provide oral and written testimony regarding proposed amendments, filed with the Division on March 29, 2005, to Rules 11 and 12 of the CAR Rules of Operation ("Rules").

In summary, the proposed amendments to Rule 11 address the formula for determining utilizations ratios and the K-factor, and the amendments to Rule 12 address participation credits for retained business written in credit-eligible territories and classifications.

Any person who wishes to testify concerning the proposed amendments is requested to submit to the Division of Insurance a Notice of Intent to Testify no later than May 27, 2005. All other interested persons will be heard after those who notify the Division in advance. All notices and submissions must be sent to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts 02110-2208, and shall refer to Docket No. C2005-02.
