Hearing Scheduled for January 26, 2005

In accordance with the provisions of Massachusetts General Laws c. 175A, c. 175E, and c. 175, § 113B, a hearing will be held on January 26, 2005, at 10:00 a.m., at the Division of Insurance, One South Station, Boston, MA, to afford all interested persons an opportunity to provide evidence and testimony relating to the operation of the Safe Driver Insurance Plan ("SDIP") on and after January 1, 2006. Any person who wishes to make a statement is asked to submit a notice of intent to testify on or before January 24. All others will be heard after those who submit such notice.

This hearing will be dependent upon a determination by the Commissioner of Insurance, pursuant to G.L. c. 175E, § 5, that competition is either (1) insufficient to assure that automobile insurance rates will not be excessive; or (2) so conducted as to be destructive of competition or detrimental to the solvency of insurers. Any hearing scheduled to begin prior to the issuance of such a determination shall begin as scheduled. Except for the scheduling changes herein, this hearing shall be conducted in accordance with the provisions of 211 CMR 77.00.

Any person who wishes to make a specific recommendation for changes to the existing SDIP must submit its filing on or before January 10, 2005. Any statutory intervenor which wishes to participate in this hearing shall submit a notice of appearance no later than January 18. Any person who wishes to intervene or to participate, other than a statutory intervenor and the SRB, must submit a petition for leave to intervene or to participate no later than January 19 and must follow the procedures contained in this Notice of Hearing and in 211 CMR 77.00. In particular, all filings shall include all direct testimony in written form and all hearing exhibits. Copies of the regulation are available from the Division.

A prehearing conference will be held on January 21, 2005 at 10:00 a.m. All parties and persons who wish to intervene or participate in this hearing must attend. The evidentiary portion of the proceeding will begin immediately following the public comment hearing on January 26. All submissions relating to this hearing shall reference Docket No. R2005-01, and shall be addressed to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, MA 02110-2208.
