Hearing Scheduled for July 15, 2005

Pursuant to the provisions of the Plan of Operation of the Commonwealth Automobile Reinsurers ("CAR"), adopted in accordance with Massachusetts General Laws Chapter 175, section 113H, a hearing will be held on July 15, 2005, at 11:00 a.m. at the Division of Insurance, One South Station, Boston. The purpose of this hearing is to afford all interested parties an opportunity to provide oral and written testimony regarding proposed amendments to Rule 13 of the CAR Rules of Operation, filed with the Division on June 15, 2005. The proceeding has been designated as Docket No. C2005-04.

In summary, the proposed amendments to Rule 13 modify the ERP subscription relief process by, among other things, allowing a servicing carrier to petition for subscription relief if it has been oversubscribed at a level of 110 percent or more for three or more consecutive months, and eliminating two- and three-party agreements between ERPs and servicing carriers.

Any person who wishes to testify concerning the proposed amendments is requested to submit to the Division of Insurance a Notice of Intent to Testify no later than July 13, 2005. All other interested persons will be heard after those who notify the Division in advance. All notices and submissions must be sent to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts 02110-2208, and shall refer to Docket No. C2005-04.
