Hearing Scheduled for August 22, 2005

In accordance with the provisions of Chapter 175A, Chapter 175E and Section 113B of Chapter 175 of the Massachusetts General Laws, hearings will be held at the Division of Insurance in order to afford all interested persons an opportunity to provide evidence and testimony relating to the fixing and establishing by the Commissioner of Insurance of fair and reasonable classifications of risks, including classifications of risks based on accident involvement, and adequate, just, reasonable and nondiscriminatory premium charges to be used and charged by companies in connection with the issue or execution for calendar year 2006 of motor vehicle insurance policies or bonds as set forth in G. L. c. 175, §113B

Any person who wishes to participate in these hearings may do so by following the procedures contained in this Notice of Hearing and in Division of Insurance regulations, 211 CMR 77.00. Except for the scheduling changes provided herein, these hearings shall be conducted in accordance with the provisions of 211 CMR 77.00. This notice also pertains to hearings in connection with the determination as to whether insurance companies utilize adequate programs to control costs and expenses, which will be conducted in accordance with both 211 CMR 77.00 and 211 CMR 93.00, Cost and Expense Containment Standards for Motor Vehicle Insurers. In particular, all filings shall include all direct testimony in written form and all hearing exhibits. Copies of these regulations are available from the Division.

All submissions relating to these hearings shall reference the appropriate docket number(s) and shall be addressed to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, MA 02110-2208.

The filing and hearing schedules are as follows:

UNDERWRITING PROFITS
(Docket No. R2005-09)
The filing by any insurer or rating organization relating to the underwriting profit component of the rates shall be submitted no later than July 8, 2005. Any statutory intervenor which wishes to participate in the underwriting profit component of the hearing shall submit a notice of appearance no later than July 11, 2005. Any person, other than a statutory intervenor and the SRB, who wishes to intervene or to participate must submit a petition for leave to intervene or to participate no later than July 13, 2005.
A prehearing conference will be held on July 14, 2005 at 10:00 a.m. All parties and persons who wish to intervene or participate in this hearing must attend.

COST AND EXPENSE CONTAINMENT AND FRAUDULENT CLAIMS PAYMENTS
(Docket No. R2005-10)
The AIB shall submit its filing relating to cost and expense containment and fraudulent claims payments, as defined in 211 CMR 93.00, no later than July 22, 2005. Any statutory intervenor which wishes to participate in this component of the hearing shall submit a notice of appearance no later than July 26, 2005. Any person, other than a statutory intervenor or the SRB, who wishes to intervene or to participate must submit a petition for leave to intervene or to participate no later than July 27, 2005.
A prehearing conference will be held on July 29, 2005 at 1:00 p.m. All parties and persons who wish to intervene or participate in this hearing must attend.

MAIN RATE HEARING
(Docket No. R2005-11)
Any insurer or rating organization shall submit any filing relating to the loss, expense and commission components of the rates no later than August 11, 2005. Any statutory intervenor which wishes to participate in this component of the hearing must submit a notice of appearance on or before August 12, 2005. Any person, other than a statutory intervenor or the SRB, who seeks to make an advisory filing shall submit a petition to intervene, together with its filing, no later than August 15, 2005. Any other person who wishes to intervene or to participate must submit a petition for leave to intervene or to participate no later than August 16, 2005.
A prehearing conference will be held on August 18, 2005, at 10:00 a.m. All parties and persons who wish to intervene or to participate must attend.

PUBLIC COMMENT
Oral statements by any persons, including those who are not parties to the hearings in Docket Nos. R2005-09, R2005-10, and R2005-11, will be heard at 10:00 a.m. on August 22, 2005 at the Division of Insurance, One South Station, Boston, MA. Any person who wishes to make a statement is asked to submit a notice of intent to testify on or before August 19. All others will be heard after those who submit such notice.
