Revised Hearings Scheduled for August 24 and September 13, 2006

Pursuant to Chapter 30A and the authority granted to the Commissioner of Insurance under Chapter 175, § 113B of the Massachusetts General Laws, hearings will be held at the Division of Insurance, One South Station, Boston, MA 02110-2208 on August 24, 2006 at 10:00 a.m. and September 13, 2006 at 2:00 p.m

The purpose of this hearing is to afford all interested parties an opportunity to provide oral and written testimony regarding proposed amendments to regulation 211 CMR 134.00 pdf format of 211_134_Proposed.PDF
, Safe Driver Insurance Plan ("SDIP"). The proposed amendments to 211 CMR 134.00 include technical changes to regulation to better implement the decision signed by Commissioner Bowler to update the SDIP for January 1, 2006. The regulation is also being modified to: (1) update the Appendix of surchargeable incidents to reflect the new motor vehicle offenses created by the recently passed Melanie's Law, Chapter 122 of the Laws of 2005; (2) remove outdated references to obsolete SDIP plans; and (3) incorporate flexibility in the provisions referring to the Merit Rating Board Manual(s) drafted in accordance with 211 CMR 134.18.

The proceedings concerning these amendments is designated as Docket # G2006-06. Any person who wishes to testify in person concerning the proposed amended regulation may appear either on August 24 or September 13, and must file a Notice of Intent to Testify with the Docket Clerk no later than August 22 for the hearing on August 24, or September 11 for the hearing on September 13. Please note that it is not necessary to appear or submit testimony at both hearings.

Persons wishing to submit written comments may do so until the record of the hearing is closed on or after September 13. All submissions must be sent to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, MA 02110-2208 and must refer to Docket # G2006-06. Persons who do not file such a Notice will be heard after those who do notify the Division. Copies of the proposed regulation are available from the Division.
