The amendments are being promulgated on an emergency basis effective January 12, 2006.

Due to the passage of Chapter 175 of the Acts of 2005 amending M.G.L. c. 176K, Medicare Supplement Insurance Plans, the Division proposes to amend these regulations to conform to federal requirements imposed by the enactment of the federal Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (MMA) which added a new Medicare Part D prescription drug benefit and made several amendments to the federal Medigap statute (42 USC 1395ss). Both state and federal amendments prohibit, as of January 1, 2006, the marketing, sale, and issuance to new enrollees of a Medicare Supplement Insurance Policy with outpatient prescription drug coverage.

Any person who wishes to testify must file a Notice of Intent to Testify to the Division on or before February 16, 2006. All other persons who wish to testify will be heard subsequent to those who notify the Division in advance. Persons wishing to submit written comments may do so until the record of the hearing is closed.
