Hearing Scheduled for February 1, 2006

In accordance with the provisions of Massachusetts General Laws, c. 175, Section 113B, a hearing will take place at 10:00 a.m. on February 1, 2006, to consider the application of the Amica Mutual Insurance Company ("Amica Mutual") to deviate downward from the fixed and established private passenger automobile insurance rates for policy year 2006. The hearing will be held at the Division of Insurance, Fifth Floor, One South Station, Boston, Massachusetts. Amica Mutual proposes to increase the multi-car discount offered pursuant to Rule 19 of the Massachusetts Private Passenger Automobile Rating Manual by 10.5 percent for those vehicles that are assigned to a driver who, under the Safe Driver Insurance Plan in effect as of January 1, 2006, qualifies for the Excellent Driver Discount Plus. The effect of the proposal is to provide a fifteen percent multi-car discount to those drivers.

The issue to be considered is whether the premium charges which the applicant desires to use are adequate, just, reasonable and nondiscriminatory and will not be used as a means of attracting only such risks as are regarded as presenting less hazard of loss than other risks in the same classification. Except for the scheduling changes provided herein, these hearings shall be conducted in accordance with the provisions of 211 CMR 77.00.

The applicant; the Automobile Insurers Bureau of Massachusetts and any member thereof; the State Rating Bureau of the Massachusetts Division of Insurance; and the Office of the Attorney General may be heard at this hearing. Any other person who wishes to participate as an interested party must submit a petition for leave to do so, including a statement of the facts and law upon which the petitioner relies to support its petition, by 5:00 p.m. on January 29, 2006. Any other person who wishes to participate in any of these hearings by making an oral statement is asked to submit a notice of intent to testify to the Division of Insurance on or before 5:00 p.m. on January 31. All other persons will be heard after those who notify the Division in advance.
