Hearing Scheduled for December 21, 2007

Pursuant to M.G. L. c. 30A, and in accordance with the authority granted to the Commissioner of Insurance under M.G.L. c. 175E, the Division of Insurance ("Division") will hold a public hearing at 10:00 a.m. on December 21, 2007, at the offices of the Division, One South Station, Fifth Floor, Boston, MA 02110-2208, regarding the repeal of 211 CMR 78.00, Procedures Concerning Rate Filings and the Conduct of Hearings for Motor Vehicle Insurance.

The purpose of this hearing is to afford all interested parties an opportunity to provide oral and/or written comment regarding the permanent repeal of 211 CMR 78.00. In accordance with M.G.L. c. 30A, § 3, this regulation was repealed on an emergency basis for 90 days effective October 19, 2007.

211 CMR 78.00 originally was promulgated to govern the form and content of rate filings and advisory filings, procedures related thereto, and the conduct of hearings pursuant to M.G.L. c. 175E, § 7 for private passenger and commercial motor vehicle insurance. This regulation was superseded as to commercial motor vehicle insurance by 211 CMR 91.00, Motor Vehicle Insurance Rates, promulgated on March 13, 1981, and as to private passenger motor vehicle insurance by 211 CMR 79.00, Private Passenger Motor Vehicle Insurance Rates, promulgated on October 19, 2007. In order to avoid inconsistent regulatory requirements applicable to the private passenger motor vehicle insurance market in the Commonwealth, the Division now seeks to repeal 211 CMR 78.00 permanently.

Any person who wishes to provide oral comment about the repeal of 211 CMR 78.00 is requested to file a Notice of Intent to Comment with the Division on or before December 18, 2007. All other persons who wish to provide oral comment will be heard after those who notify the Division in advance. Written comments may be submitted until the record of the hearing is closed. All submissions must be sent to: Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts 02110-2208, and must refer to Docket No. G2007-09.
