Hearing Scheduled for April 1, 2008

Pursuant to M.G. L. c. 30A, and in accordance with the authority granted to the Commissioner of Insurance ("Commissioner") under M.G.L. c. 175, § 113B, M.G.L. c. 175A, § 15 and M.G.L. c. 175E, § 10, the Division of Insurance ("Division") will hold a public hearing at 10:00 a.m. on April 1, 2008, at the offices of the Division, One South Station, Fifth Floor, Boston, MA 02110-2208, regarding amendments to 211 CMR 134.00, Safe Driver Insurance Plan.

The purpose of this hearing is to afford all interested parties an opportunity to provide oral and/or written comment regarding amendments to 211 CMR 134.00. In accordance with M.G.L. c. 30A, § 3, this regulation was amended on an emergency basis for 90 days effective February 4, 2008.

211 CMR 134.00, Safe Driver Insurance Plan, was amended on an emergency basis to provide for the continuous, timely, accurate and uniform collection and exchange of private passenger motor vehicle insurance claim and traffic law violation data both when private passenger motor vehicle insurance rates are fixed and established pursuant to M.G.L. c. 175, § 113B, and when private passenger motor vehicle insurance rates are filed on a competitive basis pursuant to M.G.L. c. 175E and M.G.L. c. 175A. In order to ensure continued compliance with these insurance claim and traffic law violation data collection and reporting requirements during a competitive private passenger motor vehicle insurance market, the Division now seeks to make these amendments permanent.

Any person who wishes to provide oral comment about the amendments to 211 CMR 134.00 is requested to file a Notice of Intent to Comment with the Division on or before March 28, 2008. All other persons who wish to provide oral comment will be heard after those who notify the Division in advance. Written comments may be submitted until the record of the hearing is closed. All submissions must be sent to: Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts 02110-2208, and must refer to Docket No. G2008-02.
