Pursuant to the authority granted to the Commissioner of Insurance ("Commissioner") under G.L. c. 175, §113H, a hearing will be held on June 5, 2009, at 10:00 a.m. at the Division of Insurance, One South Station, Boston, MA. The purpose of the hearing is to afford all interested persons an opportunity to provide oral and written comments regarding the Performance Standards for the Handling and Payment of Commercial Claims by Servicing Carriers adopted by Commonwealth Automobile Reinsurers ("CAR"). On April 15, 2009 the CAR Governing Committee voted to retain the Performance Standards for the Payment and Handling of Commercial Claims last approved on April 6, 2007. Pursuant to G.L. c. 175, §113H, the Commissioner must review, and approve or modify, the proposed Performance Standards every two years. The proposed Performance Standards may be examined at the offices of the Division of Insurance during regular business hours.
This proceeding has been designated as Docket No. C2009-02. Any person who wishes to make a statement concerning the Performance Standards is requested to submit to the Division of Insurance a Notice of Intent to Make a Statement no later than June 3, 2009. All other interested persons will be heard after those who notify the Division in advance. All notices and submissions must be sent to the Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts 02110-2208, and shall refer to Docket No. C2009-02.
