Hearing scheduled for July 20, 2009

Pursuant to the provisions of Article X of the Plan of Operation of Commonwealth Automobile Reinsurers ("CAR"), a hearing will take place at 10:00 a.m. on July 20, 2009, at the offices of the Division of Insurance ("Division"), One South Station, Boston, MA to consider oral and written statements about proposed amendments to Rules 21 and 30 of the CAR Rules relating to the Massachusetts Automobile Insurance Plan ("MAIP").

The CAR Governing Committee voted to adopt multi-part amendments to Rules 21 and 30 on June 3, 2009. On June 19, 2009, I notified CAR that one part of the amendment, contained in proposed Rule 21.C.1.a, was disapproved. The disapproved section addresses the eligibility requirements that an applicant to the MAIP must meet in order to benefit from the special provisions in the proposed rule amendment. I instructed CAR to reconsider the disapproved section of the amendment and to resubmit it to me by June 26, 2009. I additionally disapproved a proposed amendment to Rule 30.C.1.d that would eliminate a sunset provision regarding an insurer's obligation to pay a commission to the producer of a policy initially written through the MAIP when the insurer writes that policy voluntarily.

. Any person who wishes to provide oral comment concerning this proposed regulation must file a Notice of Intent to Comment with the Docket Clerk no later than July 17, 2009. Persons wishing to submit written comments may do so until the record of the hearing is closed. . Persons who do not file such a Notice will be heard after those who do notify the Division.
