Hearing Scheduled for February 26, 2010

Pursuant to the authority granted to the Commissioner of Insurance under G.L. c. 176E, § 4, the Division of Insurance ("Division") will hold a regulatory hearing in accordance with G.L. c. 30A, § 2, at 10:00 a.m. on February 26, 2010, at the offices of the Division, One South Station, Fifth Floor, Boston, Massachusetts 02110-2208, concerning the new fee methodology that Dental Service of Massachusetts, Inc. d/b/a Delta Dental of Massachusetts ("Delta Dental"), a nonprofit dental service corporation organized pursuant to G.L. c. 176E, proposes to use to determine what it pays participating dentists for dental services provided to their subscribers or insured dependents. The regulatory hearing will concern the proposed fee methodology for two products marketed by Delta Dental in Massachusetts: the Delta Dental Premier Plan ("Premier") and DeltaPreferred Option, a preferred provider plan ("Delta PPO").

The purpose of this public hearing is to afford all interested persons an opportunity to provide oral and/or written comment about whether Delta Dental's proposed new fee methodology complies with the standards set forth in G.L. c. 176E, § 4.

The Bureau of Managed Care in the Division's State Rating Bureau ("Bureau of Managed Care") has reviewed Delta Dental's submissions relative to its proposed new fee methodology for Premier and Delta PPO, including submissions dated October 1, 2009; November 25, 2009; and January 29, 2010 (collectively "Delta Dental's Filing"). Delta Dental's Filing, as well as related correspondence from the Bureau of Managed Care, has been placed in the hearing docket, which has been assigned Docket No. G2010-03. The Division is convening this public hearing to provide interested persons an opportunity to comment on Delta Dental's Filing.

Any person who wishes to provide oral comment is requested to file a Notice of Intent to Comment with the Division on or before February 22, 2010. All other persons who wish to provide oral comment will be heard after those who notify the Division in advance. Written comments may be submitted at the hearing, or until the record of the hearing is closed. All submissions must be sent to: Docket Clerk, Hearings and Appeals, Division of Insurance, One South Station, Boston, Massachusetts 02110-2208, and must refer to Docket No. G2010-03.
