NOTICE OF HEARING

Proposed Amendments to Regulation 211 CMR 121.00 -- Procedures Concerning Filings of Medicare Supplement Insurance Policies and Evidences of Coverage Issued Pursuant to a Cost Contract, Rates Thereof, and the Conduct of Hearings Related Thereto

Pursuant to Massachusetts General Laws Chapter 30A and the authority granted to the Commissioner of Insurance by Massachusetts General Laws Chapter 176K § 4, a hearing will be held at the offices of the Division of Insurance (“Division”), 1000 Washington Street, Boston, MA 02118-6200 on August 28, 2014 at 2:00 p.m.  The purpose of this hearing is to afford all interested persons an opportunity to comment on the proposed amendments to regulation 211 CMR 121.00 pdf format of 211-121-redlined.pdf -- Procedures Concerning Filings of Medicare Supplement Insurance Policies and Evidences of Coverage Issued Pursuant to a Cost Contract, Rates Thereof, and the Conduct of Hearings Related Thereto

The proposed amendments include changing the title of 211 CMR 121.00 to “Procedures Concerning Rate Filings Made Pursuant to M.G.L. c. 176K, and the Conduct of Hearings on Such Filings.”  The proposed amendments are intended to clarify the hearing process by streamlining the regulation and eliminating unnecessary, repetitive, outdated, and excessively detailed provisions.  The proposed amendments will make 211 CMR 121.00 more consistent with other regulations governing Division hearings.  Other changes coordinate 211 CMR 121.00 with recently promulgated amendments to 211 CMR 71 – Medicare Supplement Insurance – To Facilitate the Implementation of M.G.L. c. 176K and Section 1882 of the Federal Social Security Act.  The proposed amendments make explicit that 211 CMR 121.00 governs hearings on policies of Medicare Select Insurance. 

This proceeding has been assigned Docket No. G2014-05.  Any person who wishes to provide oral comment concerning this regulation must file a Notice of Intent to Comment with the Docket Clerk no later than August 26, 2014.  Persons wishing to submit written comments may do so until the record of the hearing is closed.  All submissions must be sent to the Docket Clerk, Hearings and Appeals, Division of Insurance, 1000 Washington Street, Suite 810, Boston, MA 02118-6200, or by electronic mail to Doidocket.Mailbox@state.ma.us and must refer to Docket No. G2014-05 in the subject line.  Persons who do not file a Notice of Intent to Comment will be heard after those who notify the Division in advance of the hearing.
